MATTERS WHICH THE MANAGEMENT TEAM SUGGESTS SHOULD BE CONSIDERED IN PRIVATE AS THE REPORT CONTAINS EXEMPT INFORMATION AS DEFINED WITHIN PART 1 OF SCHEDULE 12A OF THE LOCAL GOVERNMENT ACT 1972 AS INDICATED AND IN RESPECT OF WHICH THE PROPER OFFICER CONSIDERS THAT THE PUBLIC INTEREST IN MAINTAINING THE EXEMPTION OUTWEIGHS THE PUBLIC INTEREST IN DISCLOSING THE INFORMATION

RESOLVED:       That, under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the remainder of the business on the grounds that the items to be considered involved the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Act.

Local Government (Miscellaneous Provisions) Act 1976 - Review of a Joint Hackney Carriage/Private Hire Drivers' Licence

To consider the attached report of the Licensing Enforcement Officer.

Minutes:

The Committee considered the report of the Licensing Enforcement Officer on a review of a Joint Hackney Carriage and Private Hire Drivers’ Licence concerning the conduct of a driver licensed in the Dover district. The case was referred to the Regulatory Committee to determine whether the driver remained a fit and proper person to hold a licence in the Dover district.

 

In accordance with the approved procedure the Committee heard from the driver and their representative regarding the complaint. They reiterated their submission as set out in the agenda papers and additionally provided further information that had not been set out in the papers. The Committee noted the cooperation of the driver and the driver’s representative, and the actions implemented following the incident.

 

The Committee withdrew from the meeting, along with the legal advisors to consider its decision and upon resuming it was

 

RESOLVED:     That, having considered the complaint and the representations of the driver and their representative, the Regulatory Committee were satisfied that the driver remained a fit and proper person to hold a Joint Hackney Carriage and Private Hire Drivers’ Licence within the Dover district.

(a) Where a meeting has been broadcast via the Council’s website a recording of that broadcast will generally be available for viewing on-line for a period of 30 days from the close of the meeting. In normal circumstances this would be within 2 working days of the meeting. However, there may be circumstances where it will take longer.

      (b) The broadcasts and recordings are the copyright of the Council and may not be copied, displayed or published to the public, adapted or dealt with in any other way restricted by the Copyright, Designs and Patents Act 1988.

      (c) The Council will not make available copies of the recordings either in whole or in part other than in compliance with a legal requirement arising under The Freedom of Information Act 2000, UK GDPR, The Data Protection Act 2018 or some other enactment, rule of law or direction of a court or tribunal which is binding on it.

      (d) Dover District Council is a Data Controller under GDPR. During this live broadcast, if you are participating in the meeting your personal data will be processed. Some of the meetings will be recorded and retained for viewing for 30 days on the Council's YouTube channel. Your information will be handled securely and confidentially in compliance with data protection legislation.
