Not all meetings are broadcast. The meetings that will be broadcast are as follows: (a) Council; (b) Cabinet; (c) Dover Joint Transportation Advisory Board; (d) General Purposes Committee; (e) Electoral Matters Committee; (f) Governance Committee; (g) Planning Committee; (h) General Purposes Committee and (i) Overview and Scrutiny Committee.

For those meetings that are being broadcast there will be a link to view the live broadcast under the ‘Media’ heading below. Only those items not restricted on the agenda will be broadcast.

5.

Public Speaking

Please note that in accordance with the agreed Protocol for Public Speaking at Overview and Scrutiny, the right to speak only applies to agenda items 11, 12, 13 and 14.

 

The right of the public to speak does not apply to the following agenda items: Apologies, Appointment of Substitute Members, Declarations of Interest, Minutes, the Forward Plan, the Scrutiny Work Programme, any agenda item that is not accompanied by a written report and items that are exempt business.

 

Members of the public who successfully register to speak will have 3 minutes to speak. Please note that the public speaking arrangements do not include the right to ask questions of any district councillor, officer of the council, invited attendee or any other public speaker.

 

Members of the public wishing to speak must register to do so by no later than 2.00 pm on the second working day before the meeting.

Decisions of the Cabinet Relating to Recommendations from the Scrutiny (Policy and Performance) Committee

The Cabinet at its meeting held on 1 July 2019 considered the following recommendations from the Scrutiny (Policy and Performance) Committee:

 

·         Public Spaces Protection Order

·         Revised Statement of Policy and Principles 2019-22 under the Gambling Act 2005

·         Performance Report – Quarter 4 2019/20

 

The Cabinet decisions on these recommendations will be verbally updated to the Committee in advance of the publication of the Record of Decision on 3 July 2019.

Issues referred to the Committee by Council, Cabinet, Scrutiny (Community and Regeneration) Committee or another Committee

There are no items for consideration.

8.

Items called-in for Scrutiny or placed on the agenda by a Member of the Committee, any individual Non-Executive Members or Public Petition

(a)    Items placed on the agenda by a Member of the Committee or any individual Non-Executive Member

 

       Any individual Councillor may request that a matter is placed on the agenda of one of the Council's Overview and Scrutiny Committees by providing Democratic Support with notice of the matter prior to the agenda being published.

 

       There are no items for consideration.

 

(b)    Items the subject of Call-In

 

       Executive Decisions may be called-in by the Chairman or Spokesperson of the Scrutiny (Policy and Performance) Committee or any three non-executive members.

 

       There are no items for consideration.

 

(c)    Public Petition

 

The Council received a petition on 7 February 2019 from ‘E.U. Thinking - Dover + Deal’ asking as follows:

 

“We call on all Kent MPs, KCC and all Kent District councils to hold public consultations in all wards of all Kent district councils, before Feb 2019, to allow us, the voting public, to discuss and inform the authorities about what they need to do to save our communities from the many problems linked with the consequences if/when we leave the customs union and the single market.”

 

The petition had 307 valid signatures from a mixture of paper (166 signatures) and a third party website (141 signatures) hosted petition. A number of signatures were rejected as they did not meet the criteria for signatures (proof of living, working or studying in the Dover District) for the petition scheme.

 

Due to purdah around the district/parish council and European parliamentary elections consideration of the petition was deferred until after the elections.

 

The Petition Organiser(s) will have 10 minutes to speak in support of the petition. Following that the options open to the members of the committee are:

 

(a)  To take no further action;

(b)  To refer the matter to the Cabinet or other committee of the Council;

(c)  To undertake an inquiry or research into the matter;

(d)  To provide a written response to the petition organiser setting out the Council’s views about the request in the petition; or

(e)  To take any other action that is felt appropriate

 

For information, E.U. Thinking Dover + Deal have previously spoken at a meeting of the Scrutiny (Policy and Performance) Committee on 13 November 2018 as part of a scrutiny on the Potential Impact of Britain Leaving the European Union on the Dover District.

·         Performance Indicators (including Electrical and Fire Safety Indicators)

·         Overview of EKH’s Procurement Processes

The attention of the members of the committee is also directed to the reports of the Monitoring Officer (under Section 5A of the Local Government and Housing Act 1989) and the report of the Strategic Housing Manager being considered by the Cabinet at its meeting to be held on 1 July 2019 which are relevant to the update on LGSRs.

(a) Where a meeting has been broadcast via the Council’s website a recording of that broadcast will generally be available for viewing on-line for a period of 30 days from the close of the meeting. In normal circumstances this would be within 2 working days of the meeting. However, there may be circumstances where it will take longer.

      (b) The broadcasts and recordings are the copyright of the Council and may not be copied, displayed or published to the public, adapted or dealt with in any other way restricted by the Copyright, Designs and Patents Act 1988.

      (c) The Council will not make available copies of the recordings either in whole or in part other than in compliance with a legal requirement arising under The Freedom of Information Act 2000, UK GDPR, The Data Protection Act 2018 or some other enactment, rule of law or direction of a court or tribunal which is binding on it.

      (d) Dover District Council is a Data Controller under GDPR. During this live broadcast, if you are participating in the meeting your personal data will be processed.
